Terms of Use
1. Introduction
These Terms & Conditions (“Terms”) govern the relationship between MK Signature Travel, LLC (“MK Signature Travel,” “we,” “our,” or “us”) and you, the traveler, purchaser, or user (“Client,” “you,” or “your”). By booking travel services with MK Signature Travel or accessing our website, you agree to be legally bound by these Terms.
We act solely as an independent travel advisor and booking agent for disclosed third-party suppliers such as airlines, hotels, cruise lines, tour operators, transportation companies, and other providers (“Suppliers”). We do not own, operate, or control these Suppliers and are not liable for their acts, omissions, or performance.
2. Eligibility
You represent that you are at least 18 years of age and legally authorized to enter into contracts. If you book on behalf of others, you warrant that you have authority to do so and that all travelers agree to these Terms.
3. Booking & Payments
• All reservations are subject to availability and the Supplier’s terms and conditions.
• You are responsible for providing accurate traveler information, including names as they appear on government-issued identification.
• Payment schedules are governed by each Supplier. MK Signature Travel may collect deposits and payments on the Supplier’s behalf.
• Failure to pay balances by due dates may result in cancellation and forfeiture of deposits.
• Prices are subject to change due to Supplier pricing policies, currency fluctuations, or fuel surcharges.
4. Cancellations, Changes & Refunds
• All cancellation requests must be submitted in writing.
• Supplier penalties and MK Signature Travel administrative fees will apply.
• Some bookings are non-refundable.
• If you change travel arrangements, additional charges and Supplier change fees may apply.
• Refunds, if available, are issued solely by the Supplier and subject to their policies.
5. Travel Documents & Requirements
• It is your responsibility to obtain valid passports, visas, entry permits, health certificates, vaccinations, and other required documents.
• Many countries require passports valid for at least six months beyond your return date.
• Failure to obtain proper documents may result in denial of travel without refund.
6. Travel Risks & Safety
Travel involves inherent risks. MK Signature Travel makes no representations regarding the advisability of travel to any destination. You acknowledge and assume all risks associated with your travel, including illness, injury, political instability, natural disasters, or other unforeseen circumstances.
We strongly encourage enrollment in the U.S. State Department’s Smart Traveler Enrollment Program (STEP) and reviewing travel advisories at www.travel.state.gov.
7. Travel Insurance
We strongly recommend purchasing travel protection insurance covering trip cancellation, interruption, medical expenses, evacuation, baggage, and other unforeseen events. If you decline insurance, you assume full responsibility for losses not covered by insurance.
8. Client Conduct
You are responsible for respectful and lawful conduct during travel. Suppliers and MK Signature Travel reserve the right to remove clients from travel arrangements for disruptive, unsafe, or illegal behavior, without refund.
9. Website Terms of Use
When using our website:
• You agree not to misuse the site, post unlawful content, or interfere with its operation.
• All website content (text, images, graphics, and logos) is property of MK Signature Travel or licensed to us. Unauthorized reproduction or distribution is prohibited.
• We reserve the right to suspend or terminate access for violations.
10. Intellectual Property & Copyright
Content provided on our website and in travel materials is protected by intellectual
property laws. Unauthorized use may result in termination of your rights and legal action.
If you believe your copyrighted work has been used improperly, please notify us in compliance with the Digital Millennium Copyright Act (DMCA).
11. Disclaimers & Limitation of Liability
• MK Signature Travel provides services “as is” and disclaims all warranties, express or implied.
• We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of Suppliers or for personal injury, property damage, delays, or other losses.
• Our maximum liability shall not exceed the amount of commission or fees actually received by MK Signature Travel for your booking.
12. Indemnification
You agree to indemnify and hold harmless MK Signature Travel, its owners, employees, and affiliates against any claims, damages, or expenses arising out of your acts, omissions, or violation of these Terms.
13. Force Majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, government actions, pandemics, strikes, or Supplier defaults.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Ohio. Any disputes shall first be attempted to be resolved informally. If not resolved, disputes shall be subject to the exclusive jurisdiction of the courts located in Franklin County, Ohio.
15. Amendments
We reserve the right to update or modify these Terms at any time. Updates will be posted on our website and effective immediately unless otherwise stated.
16. Entire Agreement
These Terms, together with our Privacy Policy and any Supplier contracts, constitute the entire agreement between you and MK Signature Travel.
